John Suddaths Will May Term 1847 --
A paper writing purporting to be the last will and testament of John
Suddath Deceased was produced in open Court and the execution
and declaration thereof duly proved in open court by the
Oaths of Lewis W Jordan and William Cox two of the subscribing
witnesses thereto and admitted to record and ordered to
be certified and recorded
which will is in the following words and figures towit
In the name of God amen
I John Suddath of the county of Roane and state of Tennessee
being weak of body but sound of mind and disposing memory
do make and ordain this as my last Will and Testament in
manner and form following
First I bequeath my body to the dust and my soul to God who
gave it
Second I wish all my debts and liabilities to be settled by my
Executors as speedily as possible
Item 3d I wish my beloved wife Eveline to retain all the Balance
of my property during her life or widowhood, subject to the conditions
hereafter expressed
Item 4d I devise to my several children Vizs Stephen Benjamin Nancy
E Milton C Margerett E Francis, Eveline, & John Lewis to have
an equal portion of my estate being one eight on their getting
married or arriving at age authorizing them to draw from my
beloved wife and my Executors said portion in the way hereafter
provided for
Item 5th I wish all my children to have a reasonable education the
expenses to be paid out of the rents of my land Interest on money
etc the balance made up out of my Estate
Item 6th I wish all my children to be made equal in the division
of my Estate my wife Eveline to have an equal share with the
children or each of them and at her death her property to be equally
divided with the several children
Item 7th whereas my fatherinlaw Milton Center made deed of gifts
to Stephen & Milton two of my children each a slave one of which has
since been sold and the money deposited the other slave still in the
possession of my fatherinlaw now I wish if there should be enough
of effects falling into the hands of my executors of personal property
and the other assets without selling any of my slaves to meet all my
liabilities to retain said money at Interest for the purpose in
assisting to educate my son Milton and for him to draw the
same when he becomes of age to be deducted out of his portion
of my estate making him even in the balance of the children
also the boy John who was given to my son Stephen if he should fall into
the hands of my said son before or on his arriving at age I wish
be the balance and deducted of of his portion of said Estate
