3 April 1858 Will of Samuel Waggoner, wife Sobrina.
Sons: Samuel Jasper, Wm W., James R and Andrew Jackson.
Daughters: Lucinda Jane Richardson, Sarah Ann Richardson and Mary Ann Reynolds.
Executors: Wife Sobrina and Geo Stebbins
I Samuel Waggoner of Martinsburgh in the County of Pike and State of Illinois do hereby make and declare this my last will and testament in manner and forme following to wit First it is my will that my funeral expences and all my just debts be fully paid
Second after the payment of Such funeral expenses and debts I give devise and bequeath unto my beloved wife Sobrina Waggoner the Farm on which we now reside Situate in Said County and known and described as the South West quarter of the South East quarter of Section twenty two (22) In township Six South range Four West of the Fourth principal Meridian also Block Eleven (11) and Twelve 12 and Lot No Seven (7) and Eight (8) in Block Thirteen also the West Half of Lot Two in Block thirteen together with all the land belonging to me lying between the above named lots and the Pittsfield and Clarkesville Road in the town of Martinsburgh during her natural life and all of the live Stock Horses Cattle Sheep Hogs &c by me now owned and kept thereon also all the House hold Furniture and other articles of personal property not here enumerated or otherwise disposed of in this will during her natural life after having disposed of a Sufficient amount to pay and discharge the expenses and debts aforesaid and that at her death all the property aforesaid to her bequeathed or So much thereof as may remain unexpended to my Son Samuel Jasper and his heirs and assigns forever I also give to my beloved wife the North West of the North East of Section Twenty Two in township Six (6) South range (4) west of the fourth (4) principal Meridian provided that She my wife payes to My Daughter Lucinda Jane Richardson the Sum of One Hundred Dollars and My son Wm W Waggoner the Sum of Ten dollars within Two years after my death it is however understood that the above Mentioned forty acres of Land is to be the first land Sold to pay my debts and expences after Selling What Personal Property I have got and to pay the above mentioned Sum to Lucind Jane Richardson and Wm W. Waggoner which I give and devise unto them
Thirdly I give to My Daughter Sarah Ann Richardson the South West quarter of the North East quarter of Section Thirty Four (34) in townshhip Six (6) South range Four (4) west of the fourth principal Meridian also Ten acres in the North East Corner of the North East quarter of the North East quarter of of Section Thirty Four in Township Six (6) South range four (4) west of the fourth principal Meridian being Situated in the County of Pike and State of Illinois
Fourth I Give to my Son James R Waggoner and my Son Andrew Jackson Waggoner and my daughter Mary Ann Raynolds the following described Land to be divided Equally between them to wit the North Half of the North West quarter of Section Twenty Two also the South East quarter of the North East quarter and the North East of the North East of Section Thirty four in township Six South (6) Four (4) west of the Fourth principal Meridian which is not herein disposed of Situated in the County of Pike and State of Ills
Fifthly I bequeath to my wife the use of all Lands belonging to me during her life and that no one of my children is to come in possession of any lands that I have will to them until after my wife death and Lastly I hereby constitute and appoint my wife and George Stebbins Executrix of this my last Will and testament revoking and annulling all former wills by me made and ratifide and confirming this and no other to being last will and testament In witness whereof I the said Samuel Waggoner have hereinto Set my hand and Seal this the Tenth? day of April in the year of our lord one thousand Eight hundred and Fifty Eight

Enoch Reyolds of Said County being first duly Sworn Says that Samuel Wagoner late of Said County died on or about the 16th day of April 1858 at the Said County leaving at the time of his decease property and effects therein and also an instrument in writing which affiant believes to be his last will and testament which paper writing he now produces to the court for probate.

This day appeared in Open Court W.E. Butler and Wm. I Duffield the Subscribing witness to the foregoing and attached will and testament of Samuel Wagoner deceased who being first duly Sworn did depose and Say that they were present when the Said Will was executed by the Said Samuel Wagoner and Saw him Sign the Same on the day of the date thereof And that he then and there acknowledged the Same to be his last will and testament that they Subscribed their names as witnesses thereto at the request of the Said Samuel Wagoner in his presence and in the presence of each other and that they respectively verily believe that the Said Samuel Waggoner was then of Sound and disposing Mind and Memory and Competent to make a will
